Benchmarking Study of Electronic Discovery Practices for Government Agencies

Government attorneys and their litigation support teams face the same issues as other eDiscovery professionals, but with a special set of challenges. As public servants, government employees hold themselves to the highest standards and, in the interests of justice and accountability, they are often obligated to produce more records than their private counterparts. In particular, government agencies operate under the Open Government Directive, which makes transparency, participation, and collaboration an explicit rule.

Since 2007, IE Discovery has surveyed legal, records management, and information technology (IT) personnel within the federal government about trends in eDiscovery. Our survey investigates the scope of the eDiscovery burden, as well as the measures that government agency employees use to respond to the discovery of electronically stored information (ESI) in litigation.
