Mapping Your Network Architecture

The Federal Rules of Civil Procedure, as well as case law from around the country, are forcing lawyers to thoroughly understand their client’s data much earlier in the case. Judges expect that we will walk into their courtrooms and speak knowledgeably ~ and with authority ~ about our company or agency’s data. Further, the Federal Rule amendments provide a “safe harbor” for corporations when data is lost due to the “routine good-faith operation of an electronic information system.” If you cannot document the routine-good-faith-operation of your electronic information system, then you cannot take advantage of the safe harbor provisions carved out by FRCP 37(f). Therefore, one of the most important things in-house counsel and government agencies can do is to map their network architecture. You need to find out what types of data you have, where it lives, how it flows throughout your systems, and when it is destroyed, altered or overwritten. It comes in handy for the meet and confer conference, safe harbor considerations, as well as, for the implementation of the litigation hold. You will learn:

  • How to map your company or agency’s network architecture

  • What questions to ask the IT staff so that you get an accurate mapping

  • Security considerations when sharing the mapping with counsel

  • What does a typical IT department look like

  • How to understand back up rotations

  • Tips on how to work with IT

  • What to look for in your opponents network architecture mapping.

About the Speakers

Chris Knox

Chris Knox, CIO

With 12 years of project and resource management experience, Chris is Chief Information Officer at IE Discovery. He is responsible for the implementation of strategic initiatives and IT expenditures, as well as the development of company-wide operating procedures. Additional responsibilities include the oversight of enterprise architecture and process design development and implementation. Chris graduated from the University of Texas at Austin with a degree in Engineering and received his MBA from Syracuse University.

Prior to IE Discovery, Chris designed and implemented data collection networks for software developers and Fortune 500 corporations. Chris also previously created Geographic Information Systems for large municipalities, specializing in the development of algorithms for hydraulic models.

Stacy Jackson, Corporate Counsel

Stacy Joined IE Discovery in 1995 as a Legal Research Analyst and was named Corporate Counsel in 2001. She has managed IE Discovery's Legal Services team of more than 50 attorneys and paralegals, working directly with client attorneys in charge of cases and coordinating project management to ensure quality deliverables.

Prior to her tenure with IE Discovery, Stacy's law firm background involved representing clients in medical malpractice and product liability suits. She has extensive work experience in employment law, government contracts, and affirmative cost recovery for environmental matters. Stacy is a licensed attorney in Maryland and a member of the Association of Corporate Counsel. She holds a Bachelor's Degree in jurisprudence and a Juris Doctor from the University of Baltimore. As primary legal content developer for IE Discovery's Continuing Legal Education (CLE) program, Stacy researches and analyzes case law and legal technology trends on an ongoing basis.
